Blaine C. Kimrey is a Shareholder in the Litigation practice in Vedder Price’s Chicago office and Chair of the firm’s Media & Entertainment Litigation and Privacy, CyberSecurity & Media groups.

Clients regularly hire Mr. Kimrey to defend putative consumer class actions on a nationwide basis. He is often retained on multiple cases simultaneously by clients or at the suggestion of insurance carriers because no client of Mr. Kimrey’s has ever suffered a final contested decision of class certification or an adverse final judgment.

Mr. Kimrey prides himself on having resolved every putative class action he has ever been involved in, easily more than 100, short of an adverse final judgment (whether that be by achieving outright victory or cost-efficient resolution). Class and direct litigation topics that Mr. Kimrey regularly handles include:

  • State law consumer protection claims
  • Data breach and security
  • Illinois Biometric Information Privacy Act (BIPA)
  • Telephone Consumer Protection Act (TCPA)
  • Fair Debt Collection Practices Act (FDCPA)
  • Computer Fraud and Abuse Act (CFAA)
  • Electronic Communications Privacy Act (ECPA)
  • Communications Decency Act (CDA) §230
  • CAN-SPAM Act
  • Common law and statutory privacy and right of publicity rights
  • Intellectual property
  • Defamation
  • Trade secrets
  • Insurance coverage
  • Miscellaneous other theories of alleged consumer harm, often with a communications or technology focus
  • Environmental and Toxic Torts

Mr. Kimrey is defending or has defended cases in Alabama, Arizona, California, Colorado, Florida, Illinois, Indiana, Kansas, Louisiana, Massachusetts, Michigan, Mississippi, Missouri, Nevada, New Jersey, New York, North Carolina, Ohio, Pennsylvania, South Carolina, Texas, Utah, Virginia, Washington, Washington, D.C. and Wisconsin.

Given the nature of his practice, Mr. Kimrey regularly performs internal investigations for his clients and often is in contact with the FBI, IRS, OCR, FCC, FTC and various other state and federal regulators and attorneys general.

A former journalist at two daily newspapers (the Austin American-Statesman and the Arkansas Democrat-Gazette), Mr. Kimrey uses his background as a journalist to investigate matters and identify solutions for his clients. While his journalism background makes him an easy choice for retention by media, entertainment, advertising and technology companies, that background also serves him well in learning about and understanding other industries and areas of law, and bringing his writing, investigatory and communicative skills to bear on behalf of clients of all types.

Recognized since 2011 by Chambers USA as a leading Media and Entertainment Litigation lawyer in Illinois, Mr. Kimrey was also named in 2008 to Chicago Law Bulletin’s “40 Illinois Attorneys Under 40 to Watch” list and designated a 2009 Benchmark Litigation Future Star in Illinois. He has also been selected for inclusion in The Best Lawyers in America in the field of Litigation—Intellectual Property from 2015 to 2022. He holds an “AV Preeminent” Peer Rating by Martindale-Hubbell (the highest possible rating), was selected for inclusion from 2012 to 2021 in Illinois Super Lawyers and was selected as a Leading Lawyer from 2013 to 2023.

Mr. Kimrey is also dedicated to pro bono work, having served for six years on the Chicago Bar Foundation Board of Directors (the philanthropic arm of the Chicago Bar Association) and having won the U.S. Northern District of Illinois/Federal Bar Association 2012 Award for Excellence in Pro Bono and Public Interest Service.

He also provides prepublication and prebroadcast review of content for media (including Internet) entities and drafts and negotiates web development, licensing and other technology, publishing, and entertainment agreements.

Mr. Kimrey served on a team featured in The American Lawyer for its success in representing a major property and casualty insurance carrier with respect to homeowners’ policy claims arising out of Hurricane Katrina (Mr. Kimrey was  a subject matter expert on design, construction and maintenance of the levees in New Orleans). He also has participated in corporate internal investigations and proceedings brought by multiple state regulatory authorities against Fortune 500 companies.
