Vedder Thinking | Articles Victory in Delaware Chancery Court: Preliminary Injunction Denied

Press Release

Reader View

Vedder Price successfully defended a major financial institution and several of its employees in a high-stakes Delaware Court of Chancery action seeking to block their new employment and client relationships. After an expedited schedule and a two-day evidentiary hearing, the Court denied the plaintiff’s motion for a preliminary injunction in its entirety, agreeing with Vedder’s arguments that the contractual provisions at issue were overbroad and unenforceable and that the defendants’ actions were lawful and ethical.

This outcome underscores our team’s ability to navigate complex restrictive covenant disputes and deliver game changing results under intense time pressure. The decision reinforces Delaware’s careful scrutiny of overreaching non-solicitation clauses and its balanced approach to employee mobility.

Congratulations to our trial team, led by Kimberley Lunetta and Jeanah Park, with critical assistance from John Guyette and Elvira Razzano, for their strategic advocacy and tireless work in achieving this important result.
