Brian K. McCalmon is a Shareholder in the Litigation practice area in the firm’s Washington, DC office.

Mr. McCalmon focuses his practice on Antitrust & Trade Regulation, defending corporations and individuals in civil investigations by government entities such as the Department of Justice (DOJ), Federal Trade Commission (FTC) and state attorneys general. A majority of his practice is in Hart-Scott-Rodino (HSR) and non-HSR mergers and acquisitions investigations before DOJ, FTC and state attorneys general. His representations have included 20 years of merger clearances in a wide range of industries, including waste services, paper and paperboard, airlines, medical devices, funeral services, security screening, pharmaceuticals and telecommunications. He also handles monopolization and price-fixing investigations as well as civil antitrust and class action litigation.

Mr. McCalmon’s past experience includes multiple representations in nearly every aspect of healthcare, including providers, pharmaceutical companies, laboratory testing services and medical devices. He has also led multiple representations in every aspect of the product lifecycle – from licensing to manufacturing, transportation, distribution and finally to disposal or recycling. He counsels individuals and companies on warranty issues arising under the Magnuson-Moss Warranty Act and has overseen the worldwide drafting of consumer warranties for multinational products manufacturers. Mr. McCalmon also regularly counsels individuals and companies on the legality of their and their competitors’ advertising campaigns and on issues ranging from substantiation of scientific claims to labeling practices governed by FTC regulations and labeling statutes.

  • Represented a medical device manufacturer in its acquisition of a competitor.
  • Represented an airline in the DOJ investigation of a major merger of two airlines.
  • Represented a rain industry supplier in the acquisition of assets required to be divested in a merger between competitors.
  • Represented a services company in monopolizations investigations.
  • Represented a rate bureau defendant in a price-fixing class action in the less-than-truckload transportation industry.
  • Represented a ski resort in a monopolization case through appeal to the Second Circuit of the case’s dismissal.
