Vedder Price is pleased to announce a recent bench trial victory in a complex commercial eviction case pending before the Siskiyou Superior Court.

Vedder Price, led by Shareholder Michelle Landry, represented Miner’s Inn LLC, a hotel owner, seeking to evict a hotel management company, Yreka Hospitality LLC, that was operating the Best Western Miner’s Inn pursuant to a master lease. Yreka Hospitality LLC refused to vacate the premises and turn over possession of the hotel following lease termination, claiming it had a purchase option which prohibited the use of California’s summary eviction procedures.

At the conclusion of the trial, the court found that because possession of the property was achieved through the landlord-tenant relationship, as opposed to that of vendor-vendee, unlawful detainer was an available method of regaining possession of the property.

“Our client is very happy with the court’s ruling on this matter, allowing it to quickly recover a valuable hotel asset,” said Landry. “We also believe it’s a positive and very impactful outcome that is relevant to other property owners who want to use an expeditious remedy of eviction in their commercial disputes.”
