Vedder Thinking | News Thomas J. Kowalski Provides Testimony for USPTO Report on Genetic Diagnostic Testing
Thomas J. Kowalski, Shareholder and member of the firm’s Intellectual Property practice group, testified before the U.S. Patent and Trademark Office (USPTO) today during the first of two hearings on independent second opinion genetic diagnostic testing in which patents and exclusive licenses protect primary genetic diagnostic tests. Testimony was provided during these hearings under the Leahy-Smith America Invents Act (AIA).
Mr. Kowalski provided testimony at a previous USPTO hearing on prior user rights in October 2011, which was cited in the Prior User Rights Defense Report. For more information on the AIA, see Vedder Price’s Client Alert "Leahy-Smith America Invents Act," which was co-written by Mr. Kowalski and Ms. Deborah L. Lu, Ph.D.
