Partner Sam Tyfield was recently quoted in the Futures and Options World article, “Irish Privacy Case May Impact Financial Firms – Lawyer.” The article discusses a recent Irish High Court social media privacy case between Facebook and an Austrian citizen over personal data transfers between Facebook’s European and U.S. branches. The Court sent a list of privacy questions to the European Court of Justice regarding how data breaches should be examined, what should be transferred via the “Privacy Shield,” etc.
Mr. Tyfield weighed in on what the impact of this decision could have, stating “In the worst case, the EU data privacy regulators could take the approach now that there is a rebuttal presumption that a firm which either relies on the Privacy Shield or standard contractual clauses is not providing adequate protection to EU personal data and will make the rebuttal of that presumption more difficult.”
