Vedder Thinking | News Sadina Montani Discusses EEOC and DOJ Heightened Focus on Harassment and Discrimination in State and Local Governments in Law360

Labor & Employment Shareholder Sadina Montani recently commented on the EEOC and DOJ’s recent Memorandum of Understanding (MOU) related to various types of harassment and discrimination Charges of Discrimination filed against state and local government employers in Law360.
"I suspect that the most immediate impact [of the MOU] will be the level of aggressiveness the EEOC attacks its investigations with … and how aggressively it goes after state and local agencies at the conciliatory stage," said Ms. Montani. "If there is at least a greater possibility that the DOJ brings an action, which I think this MOU certainly signals, it seems to me that there will be more pressure on state and local governments to settle with employees at the conciliation stage if there is a finding of probable cause."
She also states that there is no better time than the present to "think proactively" about managing discrimination and harassment internally, through preventative measures as well as prompt but thorough investigations should internal complaints surface. She says one basic step those employers can take in advance of an EEOC probe is to make sure their existing policies are in tune with relevant anti-discrimination and anti-harassment laws.
