John W. Whittlesey


John W. Whittlesey is an Associate in Vedder Price's Chicago office. His practice focuses on commercial litigation, intellectual property and data privacy.

Mr. Whittlesey represents and counsels corporations and individuals in a range of substantive areas in U.S. federal and state courts, arbitrations, mediations and government and internal investigations. He has extensive experience litigating complex commercial matters involving breach of contract, breach of fiduciary duty, fraud, business torts, enforcement of restrictive covenants, trade secret and trademark violations, securities violations, bankruptcy, directors and officers liability, FINRA broker-dealer disputes, products liability and other commercial matters.


Mr. Whittlesey has developed a special concentration counseling clients and litigating issues pertaining to trade secrets, the enforcement and enforceability of restrictive covenants, data theft and unfair competition.  He litigates all aspects of covenant and trade secret claims, and he has substantial experience with applications for temporary restraining orders and preliminary injunctions.  He counsels clients with respect to drafting enforceable restrictive covenants, including noncompetition, nonsolicitation, confidentiality and nondisclosure covenants.  He regularly drafts and implements computer forensic analysis protocol agreements as a discovery tool to uncover employee data theft and other computer fraud and abuse.


Mr. Whittlesey also has significant experience litigating disputes involving securities broker-dealers, investment advisors and individuals in FINRA arbitrations, in state and federal courts, and in proceedings brought by the U.S. Securities and Exchange Commission, FINRA and other federal and state regulatory agencies.


In addition to his litigation experience, Mr. Whittlesey regularly counsels clients on data privacy matters, including responding to and protecting against data breach incidents and ransomware attacks; managing the privacy risks associated with maintaining and transferring information; and complying with statutory and contractual data protection requirements.  He also counsels clients on how to protect corporate assets, including confidential and proprietary data, information and trade secrets and employee relationships. Mr. Whittlesey has earned the designation Certified Information Privacy Professional (CIPP/US) through the International Association of Privacy Professionals (IAPP), and he is a member of IAPP.


Prior to joining Vedder Price, Mr. Whittlesey worked as an associate at DLA Piper LLP (US), and he served as a law clerk to the Honorable Peter C. Economus of the U.S. District Court for the Northern District of Ohio.


Mr. Whittlesey was selected as an Illinois Emerging Lawyer, an affiliate of Leading Lawyers, from 2014 to 2017.
