John C. Cleary is a Shareholder at Vedder Price and a member of the firm’s Litigation, Privacy, CyberSecurity & Media, Insurance and Intellectual Property practice groups.

Mr. Cleary’s litigation experience spans a wide spectrum of subject matter areas, with particular emphasis on commercial, intellectual property, data security and insurance disputes, as well as pre-litigation engagements in a wide array of subject matters.

Prior to joining Vedder Price, Mr. Cleary was a partner at Dewey & LeBoeuf LLP, where he litigated insurance, intellectual property, antiterrorism, bankruptcy and environmental matters. He served for several years as an Assistant U.S. Attorney in Washington, DC, representing U.S. government agencies and officials in a range of constitutional and other federal sector issues.

Representative matters include:

  • Representation of U.S. companies involved in data security incidents and other cyber controversies
  • Representation of cruise ship charterer and multinational investors in maritime arbitration and letter of credit matter in New York
  • Representation of Lloyd’s and London market interests in civil suits and reinsurance arbitrations arising out of extended warranty coverage for U.S. and Canadian automobiles and personal computers
  • Representation of U.S. air treatment company suing U.S. and foreign infringers of a U.S. patent on desiccant-based technology for air conditioning and heat recovery
  • Representation of U.S. design and manufacturing company suing an aircraft manufacturer in the Russian Federation for wrongful misuse of intellectual property
  • Representation of London-based insurers in multinational cargo case involving salmonella contamination of pistachios
  • Resolution of dual forum aircraft finance collection matter in California and New York
  • Representation of gas transmission company to enforce contractual rights under the federal filed rate doctrine in a bankruptcy proceeding
  • Representation of Bermuda and U.S. companies in captive insurance disputes under New York and Bermuda law
  • Patent litigation in the metallurgical field, involving high-performance aerospace alloys
  • Representation of the U.S. Office of Foreign Assets Control in connection with blocking of assets in the first Gulf War (1990–91)
  • Defense of aluminum manufacturer through multiple successful stages of a toxic tort class action alleging personal injury and property damage in St. Croix, U.S. Virgin Islands
  • Amicus briefing on behalf of the New York Intellectual Property Law Association of the so-called “pay-for-delay” patent-antitrust case before the U.S. Supreme Court (FTC v. Watson)
  • Amicus briefing on behalf of the Maritime Law Association of the United States of the “vessel status” maritime case before the U.S. Supreme Court (Lozman v. City of Riviera Beach)
