James M. Kane

James M. Kane is a Shareholder and a member of the firm's Financial Institutions practice group.

From 1981 until joining Vedder Price, he was the district counsel in Chicago for the Office of the Comptroller of the Currency (OCC). As the chief legal officer for the OCC Central District, Mr. Kane served as a member of both the district’s senior management group and the supervisory review committee. He was responsible for providing legal and policy advice to the Deputy Comptroller and the 500 examiners of the Central District. In this capacity, he oversaw the resolution of complex and often contentious legal issues on a wide variety of matters, including product expansion, affiliate transactions, consumer compliance and securities laws. He represented the OCC in well over 100 enforcement actions involving both banks and individuals. He was frequently recognized inside the OCC for his leadership and innovative approaches. Several of the decisions of which he was an integral part were upheld by both federal district and appellate courts.

In 1993, Mr. Kane joined Vedder Price. His practice is focused on financial institutions and their officers and directors. He serves his clients in a number of different capacities. Including as the regulatory and corporate counsel for many institutions. Calling upon his experience as a regulator, as a past director of two different community banks and as a private practitioner for over 20 years. In this capacity, he works with clients on general corporate, regulatory and securities matters, on new products and on mergers and acquisitions.

His enforcement experience with the OCC has made him an acknowledged leader in understanding today’s regulatory environment. This experience, coupled with his general knowledge of banking, gained through his role as a regulator, a director and a private practitioner, provides him with a perspective that few other attorneys can match. His skills and experiences have proved invaluable to institutions and individuals alike. Operating as part of the Vedder Price Financial Institutions group, Mr. Kane has provided advice and counsel to numerous individuals confronted with possible personal liability resulting from their service as a director or officer of a bank. As part of this same team, Mr. Kane has provided advice and counsel to numerous financial institutions confronting possible liability, both civil and administrative, resulting from the nation’s consumer laws.

Mr. Kane received an “AV Preeminent” Peer Rating in Martindale-Hubbell. He has also been selected by his peers as a “Leading Lawyer” in Banking and Financial Institutions from 2013 to 2023.

Mr. Kane has been recognized by The Best Lawyers in America: Ones to Watch for the categories of Banking and Finance Law and Financial Services Regulation Law since 2022.
