Vedder Price shareholder Michael J. Waters represented Texas 1845 in a breach-of-contract case in which Texas 1845 sought payment from Daniel Dvorkin, Dvorkin Holdings, LLC and Dan Air, LLC (defendants) for their breach of two aircraft loan guaranties.  Following a bench trial on the issue of damages, the trial court entered judgment in favor of Texas 1845 in an amount over $8.256 million.  In their appeal, the defendants maintained that the judgment should be reversed outright because the trial court erred in admitting into evidence various exhibits regarding Texas 1845’s damages.

On May 16, the Illinois Appellate Court upheld all of the trial court’s evidentiary rulings and affirmed the entirety of the $8.256 million judgment.
