London Associate Esther Langdon recently published “Workplace Training – Getting it Right” in HR Magazine. Ms. Langdon examines the recent case of Allay v Gehlen in the Employment Appeal Tribunal (EAT), shining a spotlight on the importance of workplace training and the reasons for it – whether as a legal requirement or to protect the employer’s position if things go wrong.

The employee in this case, Mr. Gehlen, was subjected to racist comments on a regular basis made by a fellow employee. The employer countered by relying on the ‘reasonable steps’ defense, citing that employers can defend themselves if they demonstrate the reasonable steps taken to prevent an employee from acting in a particular way.

Through Allay v. Gehlen, Ms. Langdon provides a good reminder that “policies and training should not be a one-time-only, tick-box affair.”
