John C. Cleary, Vedder Price Shareholder and member of the firm's Data Privacy & Security practice group, was quoted in the May 12 Law360 article titled "4 Tips For Disclosing A Data Breach To Regulators." The article touches on how businesses are reluctant to share information about data security threats and breaches with regulators and law enforcement agencies, and describes how businesses can approach these situations collaboratively without introducing costly liability risks and business disruptions.
Last month, the U.S. Department of Justice released a set of best practices to help businesses deal with data security threats in a cooperative way. Mr. Cleary commented, "The guidance document goes out of its way to encourage engagement and partnership with law enforcement, both before and after a breach incident, [and] also stresses the importance of confidentiality and avoidance of business disruption to private-sector companies impacted by breach incidents, and makes minimizing or avoiding these impacts a priority for law enforcement."
