Kevin J. Etzel is an Associate in the New York office of Vedder Price and a member of the firm's Litigation group.

Mr. Etzel is a distinguished creditors’ rights attorney with a decade of experience representing financial institutions, credit unions and private lenders in a wide range of complex legal matters. With a primary focus on bankruptcy proceedings, contested litigation, commercial foreclosures, collections and loan workouts, Mr. Etzel is a trusted advocate for the firm’s clients, with a proven track record of success. As outside general counsel, Mr. Etzel also possesses extensive knowledge of the Firm’s legal services, efficiently guiding clients to the most suitable practice groups to maximize value and meet their objectives.

Bankruptcy and Insolvency

Specializing in complex bankruptcy and insolvency proceedings, Mr. Etzel is well-versed in important areas such as cash collateral, debtor-in-possession financing, Section 363 sales, equipment sale and leasing disputes, preference and fraudulent transfer disputes, and the prosecution and defense of adversary proceedings. 

Litigation and Judgement Enforcement

Mr. Etzel is also a skilled litigator representing the Firm’s clients in state, federal and appellate courts, in, among other things, breach of contract, replevin and lender liability actions.  Importantly, Mr. Etzel’s expertise incorporates all aspects of judgment enforcement, including strategic negotiations, asset discovery, lien enforcement and the pursuit of fraudulent transfers, ensuring that clients maximize their recovery on any judgment and often achieving outcomes that exceed the client’s expectations.

Loan Workouts and Dispute Resolution

Mr. Etzel’s skills also extend beyond the courtroom to loan workouts, mediation and arbitration, providing clients with more cost-effective alternatives to traditional litigation.  The Firm’s clients look to Mr. Etzel for experienced, practical guidance, balancing business objectives with legal considerations and budgeting. 

Leadership and Philanthropy

Mr. Etzel also serves on the Emerging Leaders Council of the Federal Enforcement Homeland Security Foundation, a not-for-profit organization that provides financial assistance to the families of federal law enforcement agents that are killed or seriously injured in the line of duty.

  • Since 2020 alone, successfully negotiated global multimillion-dollar settlements, including sums in excess of $2,500,000, $4,000,000, $5,500,000, $8,500,000 and $10,400,000.
  • Successfully obtained orders of attachments against fleet owners prohibiting the transfer of assets, including real property and ownership interests in corporations and limited liability companies.
  • Successfully disregarded fraudulent transfers made by judgement debtors to third parties in an attempt to evade lenders’ enforcement of multimillion-dollar judgements.
