Risk Management Issues
In the course of representing health providers, our attorneys have developed extensive experience in risk management techniques, including the review and development of internal provider processes to reduce exposure or improve control and reporting of incidents leading to unnecessary risk levels. In addition, we have assisted in the creation of structures and relationships with related and commercial insurers or risk-bearing entities to efficiently and effectively fund for unavoidable risk contingencies. Representative projects include:
- Assessing risk management and liability issues in connection with managed care initiative and utilization review programs.
- Creating an insurance trust to pool risk among providers within multihospital health system.
- Creating self-insurance trust programs on behalf of professional and trade associations.
- Forming an offshore captive insurance company to bear primary or excess risks, as well as interfacing with commercial reinsurance markets.
- Auditing risk management practices and recommending changes necessary to implement formation of expanded hospital/non-institution provider network.
