The firm's environmental practice includes Superfund litigation and dispute resolution, underground storage tank litigation and counseling, hazardous waste handling, treatment, storage and disposal litigation and dispute resolution, and transactional counseling. Superfund Liability
Vedder Price attorneys have negotiated remedies for Superfund sites across the nation. The firm represents potentially responsible parties in Superfund litigation brought by governmental agencies and also represents both plaintiffs and defendants in private party cost recovery and contribution litigation as well as in Alternative Dispute Resolution and allocation proceedings.
Underground Storage Tanks
Vedder Price regularly represents clients with respect to all issues involving underground storage tanks. Firm attorneys have also successfully represented clients in obtaining the maximum reimbursement under the Fund and have been at the forefront in proceeding under the Resource Conservation and Recovery Act to recover past clean-up costs for petroleum contamination. We counsel clients regarding installing, operating, upgrading, and removing fuel oil and hazardous substance underground storage tanks.
Transactional Counseling
Our environmental practice also includes rendering advice regarding environmental implications and liabilities in the context of corporate mergers, acquisitions and divestitures, and the purchase, sale, and financing of real estate, including "Brownfield" development. We have represented lenders, buyers, and sellers in hundreds of financings and real estate and corporate transactions throughout the country. We also advise lenders on how to insulate themselves from environmental liability in work-out and foreclosure situations.
