Roy P. Salins, associate, published the article “Trade secrets: At the crossroads of intellectual property and labor and employment law” in a recent issue of Journal of Commercial Biotechnology.
The article discusses the vital importance of protecting proprietary trade secrets from misuse by employees in the biotech industry, as these trade secrets are crucial to a company’s competitive advantage and financial success.
Specifically, Mr. Salins explains the following: how trade secrets are generally defined; the law concerning the enforceability of a contractual provision aimed at protecting trade secrets, as well as common-law protections available to employers; and recent trends in criminal prosecution of employees and former employees who misappropriate trade secrets.
Mr. Salins is a member of Vedder Price’s Labor and Employment and Litigation practice groups.
