John C. Cleary is a Shareholder at Vedder Price and a member of the firm’s Litigation, Insurance and Intellectual Property practice areas.

Mr. Cleary’s litigation experience spans a wide spectrum of subject matter areas, with particular emphasis on insurance, energy and intellectual property disputes, as well as preventive law and prelitigation counseling.

Prior to joining Vedder Price, Mr. Cleary was a partner at Dewey & LeBoeuf LLP, where he litigated patent, insurance, antiterrorism, securities, antitrust, bankruptcy and environmental matters. He served for several years as an Assistant US Attorney in Washington, DC, representing federal agencies and officials in a range of constitutional and other federal sector issues.

Representative matters include:

  • representation of Lloyd’s and London market interests in civil suits and reinsurance arbitrations arising out of extended warranty coverage for US and Canadian automobiles and personal computers;
  • representation of Bermuda and US companies in captive insurance disputes under New York and Bermuda law;
  • representation of London-based insurers in multinational cargo case involving salmonella contamination of pistachios;
  • representation of US importers in successful challenges to the constitutionality of the Federal Harbor Maintenance Tax;
  • representation of maritime union pension and benefit funds in contested ERISA matters in federal court;
  • patent and antitrust litigation in the metallurgical field, involving high-performance aerospace alloys;
  • representation of gas transmission company to enforce contractual rights under the federal filed rate doctrine;
  • defense of aluminum manufacturer through multiple successful stages of a toxic tort class action alleging personal injury and property damage in St. Croix, US Virgin Islands;
  • affirmative recovery for California real estate client after prolonged multivenue litigation arising out of complex real estate transaction;
  • favorable multiparty resolution of complex environmental, bankruptcy, criminal and corporate control dispute in Washington state; and
  • representation of the US Office of Foreign Assets Control in connection with blocking of assets in the first Gulf War (1990–91).
