Eric A. Berg focuses his practice on construction law, in both litigation and transactional work. As a litigator, Mr. Berg has represented owners, contractors, subcontractors, architects, engineers, and lenders. Specific examples include prosecuting construction defects suits, arbitrating a differing site conditions claim, defending the municipal owner of a water treatment facility against a contractor's equitable adjustment claim, representing a general contractor joint venture regarding a minority-owned business enterprise participation dispute, and obtaining a not-guilty verdict on behalf of a sports stadium designer in a personal injury claim. Mr. Berg also has extensive experience in other areas of commercial litigation and alternative dispute resolution.

In addition, Mr. Berg is well versed in all facets of the Americans with Disabilities Act and the Fair Housing Act. For numerous clients, Mr. Berg has provided counsel on interpretation of and compliance with the ADA, the FHA, and other federal, state, and local accessibility statutes.

Mr. Berg's transactional work includes drafting and negotiating contracts for the design, construction, rehabilitation, and construction management of hotels, hospitals, office buildings, apartment buildings, private residences, retail stores, factories, and warehouses.

Mr. Berg is an active member of the American Bar Association (Construction Forum) and is a Professional Affiliate Director of the American Institute of Architects–Chicago.

The respected English publisher Chambers and Partners lists Mr. Berg in Chambers USA: America's Leading Lawyers for Business, calling him "terrific and experienced." Who's Who Legal: Illinois 2008 describes Mr. Berg as an "extremely sophisticated lawyer" with a "very fine reputation."  Mr. Berg has been named an Illinois Super Lawyer in every year since 2006. He is AV® rated by Martindale-Hubbell, the highest rating available.

Transactions of particular note include the following:

  • Created standard agreements for national developer of over $2 billion in residential construction projects;
  • Drafted architect contract on a $200+ million showroom complex and convention center;
  • Established master construction contracts for an $18 billion international technology company;
  • Developed $168 million owner/contractor agreement for a mixed use facility, including 358 condominium units;
  • Drafted design services agreement and construction contract for a developer client of $100 million, 420-unit apartment complex with historic rehabilitation and retail elements;
  • Developed form agreements for national developer of $100+ million high-rise complexes;
  • Acted as lender’s counsel in $99 million apartment, garage, retail, condominium and townhouse complex;
  • Represented contractor in $88.5 million senior residences complex; and
  • Acted as attorney for developer in $80+ million multi-tenant shopping mall/apartment/parking garage complex in northern Virginia, with $12 million in contractor claims.
