James T. FitzGibbon, Of Counsel with Vedder Price, focuses his practice on patent, trademark and copyright matters.  With more than 40 years of experience in the field, he began his career as a corporate patent attorney, first for National Gypsum Company in Buffalo, New York, and then for National Can Corporation in Chicago. He then entered private practice where he has been engaged for more than 35 years. 

Mr. FitzGibbon's experience includes both jury and bench trials in patent, copyright and trademark matters.  He has been lead counsel for both plaintiffs and defendants in more than 30 patent cases and over 30 trademark and copyright cases.  He has obtained and opposed preliminary injunctions and temporary restraining orders.  He has prosecuted and defended appeals to the Federal Circuit and various Courts of Appeal.  Mr. FitzGibbon has been engaged in extensive patent prosecution for a large number of clients, some of whom he has represented for more than 40 years.  He has prosecuted innumerable appeals to the Patent Office Board of Appeals & Interferences, the Court of Customs and Patent Appeals and, more recently, to the Court of Appeals for the Federal Circuit.  He has successfully represented numerous clients in patent and trademark interferences.

Mr. FitzGibbon has written articles on copyright law and has prepared annual updates on intellectual property law in Illinois for ICLE. He has taught continuing legal education programs and provided expert testimony in a number of cases, ranging from the General Motors Engine Swap Litigation to Toro v. White Consolidated Industries.
