Thomas J. Kowalski Testifies for USPTO Report on Prior User Rights Under the America Invents Act
(CHICAGO)—Thomas J. Kowalski, Shareholder and member of the firm’s Intellectual Property practice group, testified before the U.S. Patent and Trademark Office (USPTO) today during hearings on prior user rights under the America Invents Act (AIA).
The AIA, which changed the U.S. patent system from “first to invent” to “first to file,” was signed into law last month. The USPTO has since been called upon to report to the Judiciary Committee of both the Senate and House on sections within the AIA that address prior user rights. Mr. Kowalski provided testimony from a practitioner’s perspective.
