Thomas J. Kowalski’s Testimony Cited in America Invents Act Report on Prior User Rights
Thomas J. Kowalski, Shareholder and member of the firm’s Intellectual Property practice group, was cited in the Prior User Rights Defense Report, one of two intellectual property law studies required by the America Invents Act that were released by the United States Patent and Trademark Office (USPTO) last week.
The report contains commentary and witness testimony gathered at public hearings held by the USPTO last October. Mr. Kowalski provided witness testimony from a practitioner’s perspective. (See Thomas J. Kowalski Testifies for USPTO Report on Prior User Rights under the America Invents Act.)
Mr. Kowalski’s testimony was referenced throughout the report, including his remarks that prior user rights being available outside the US, but not inside the US, “could lead to the exporting of manufacturing.” He was also quoted liberally on the constitutionality of prior user rights.To access the entire report, please click on the link below.
