Laura Sack Comments on New Type of Discriminatory Hiring Practice

Laura Sack, a Shareholder with Vedder Price’s Labor and Employment Group, was quoted in a recent Business Insurance article entitled “New Type of Hiring Discrimination Claim in Works.”
The article discusses the Equal Employment Opportunity Commission’s (EEOC) interest in challenging employers who only consider employed individuals as candidates for job vacancies. The EEOC is deliberating action that, according to the article, could range from a policy statement to test litigation that would challenge employers that hire only people who are employed.
Sack commented on the issue, noting that, for spurned job applicants whose applications were rejected solely because they are unemployed, it will be “easier to go forward, to get the EEOC’s attention with this kind of a claim, than it would have been in the past.” Sack added that plaintiffs’ attorneys might be tempted to pursue such claims by means of class action litigation, which “would certainly make it more worth their while.”
