On Tuesday, March 30, Vedder Price Shareholder Brian K. McCalmon will be speaking at a webinar on antitrust and eDiscovery issues, entitled “Key Considerations for HSR Second Request Productions: Corporate, Law Firm, and Service Provider Perspectives.”

The event will focus on company’s responses to Second Requests issued by DOJ or FTC under the Hart-Scott-Rodino Antitrust Improvements Act of 1976, as amended (HSR Act). The HSR Act is a key antitrust regulation governing mergers, acquisitions, and other business combinations, which requires parties to a covered transaction to notify the transaction to the FTC and DOJ, provide certain information about the transaction and the parties, and observe a waiting period prior to consummation. The investigating agency may delay the consummation of the transaction by issuing a lengthy subpoena for documents and information, colloquially known as a Second Request. Responding to Second Requests under the Act requires close and continuous cooperation between counsel, client, and production vendors throughout the eDiscovery lifecycle. Each progressive step demands meticulous attention and coordination, with the looming threat of one wrong decision derailing the entire investigation.

Mr. McCalmon will be joined by co-panelists, Kristen Ford of Waste Management and Frank Gall, Senior Vice President at Compliance, to discuss key considerations and best practices for navigating productions under the HSR Act.
