Michael J. Waters is a Shareholder in Vedder Price's Chicago office and is a member of the firm's Litigation group. Mr. Waters has experience handling all phases of litigation, from emergency injunctions through trial and appeal, in a broad range of commercial litigation matters. He has appeared and successfully argued in both state and federal appellate court, and has participated in arbitrations before the American Arbitration Association and Financial Industry Regulatory Authority. He is also a contributing author for the 2009 edition of the Illinois Institute for Continuing Legal Education Civil Trial Evidence handbook.
Mr. Waters has considerable experience in antitrust litigation, internet litigation and dispute resolution, mergers and acquisition litigation, banking and lending disputes, product liability litigation, and handling disputes in the health care industry. He also regularly works with the firm's Intellectual Property group and has significant experience litigating matters of trademark, copyright and patent infringement, as well as trade secret misappropriation, unfair competition and restrictive covenant claims.
In addition to his antitrust litigation experience, Mr. Waters serves as Assistant Editor of the American Bar Association’s Antitrust Law Journal. He is a contributing author to Private Enforcement of Antitrust Law in the United States: A Handbook and has co-authored articles on developments in antitrust law, including: "Counsel Beware: Preventing Spoliation of Electronic Evidence in Antitrust Litigation," in Antitrust (Summer 2006); "Early Returns: Impact of the Class Action Fairness Act on Federal Jurisdiction over State Law Class Actions," in Antitrust (Summer 2011); "Judicial Application of the Twombly/Iqbal Plausibility Standard in Antitrust Cases," in Antitrust (Fall 2011).
Mr. Waters also counsels all industry sectors in connection with the retention and management of electronic and hard copy data and records. This includes counseling clients on privacy and data security issues and assisting clients in preparing for and responding to data security breaches, as well as advising clients on eDiscovery issues. Mr. Waters regularly speaks on these topics and his articles on these issues have appeared in Antitrust, Privacy & Data Security Law Journal and the Illinois Manufacturer.
In addition to his activities on behalf of Vedder Price and its clients, Mr. Waters has volunteered his time to provide legal services to children and in support of children's issues in conjunction with the Children and Family Justice Center of the Northwestern University School of Law’s Bluhm Legal Clinic, and has represented those in the creative arts in connection with Lawyers for the Creative Arts.
Mr. Waters was selected for inclusion from 2009 to 2012 in Illinois Rising Stars.
